Booking Arrangements  
 

A booking will be confirmed when the owner has received a deposit of 50% of the charter fee. The owner will send out a confirmation invoice normally within 24 hours. If the charter is booked over six months in advance 25% is collected with the remaining 25% due six months prior to the charter date.

Final payment will be due 8 weeks before the charter date.

Any extra costs should be paid to the captain in cash at the end of the charter.

If the charterer cancels and the yacht remains unbooked the charterer forfeits the deposit held.  

If the charterer cancels and the yacht is rebooked for the same period of time, the deposit held for the yacht is refunded, less a 10% booking fee.

If the charterer cancels and the yacht is rebooked for a portion of the time frame, a refund is made on a pro-rata basis, less a 10% booking fee.

If the yacht becomes unfit or unavailable for charter the owner will attempt to find an alternative yacht for the charterer and his party or the deposit held will be refunded.

Should any instalment of the charter money not be paid on the due date the owner has the right to cancel the charter and retain any deposit already paid.

 
Liability
 

Damage to the yacht or equipment, or loss of equipment through negligence or deliberate misconduct of the charterer and or any member of his party will be charged to the charterer, at the owners sole disgression.

The owner shall not be held responsible for any injury or death suffered by the charterer or any member of his party during the term of this charter regardless of whether such injury may occur on board the yacht or elsewhere. This includes injuries or deaths due to swimming or the use of snorkels, scuba gear, water skis, windsurfers, mountainbiking, hiking or similar sports or sports equipment whether supplied by the owner or the charterer.

The owner shall not be held responsible for any loss or damage to the charterers personal property or any property belonging to a member of his party.
 
Authority
 
The owner agrees to provide the yacht with a captain and crew. The captain shall be competent in both coastwise and offshore navigation and hold an appropriate captains license. While it is agreed that the charterer may determine the general movements of the yacht, the captain is in full command and the decision of the captain shall be final in all matters concerning the operation of the vessel.
 
Further agreements
 
There will be no smoking allowed below decks or in the cabins. Smoking will only be allowed on deck. Use or possession of illegal drugs on board the yacht shall result in immediate termination of the charter with forfeiture of all monies paid.
